What Is an HMO and When Is a Licence Required?

An HMO is a property rented by three or more people who are not from the same household (i.e., not a family) and who share facilities such as a kitchen or bathroom. A mandatory HMO licence is required for properties occupied by five or more people forming two or more separate households. Many local councils also operate additional licensing schemes that cover smaller HMOs. The Management of HMOs Regulations 2006 set out the specific duties of HMO managers in England and Wales. These include maintaining the structure and exterior of the property in good repair, ensuring all installations are in working order, maintaining common areas in a clean and tidy condition, providing adequate facilities for the disposal of refuse and litter, and taking reasonable steps to ensure the property is free from damp and mould. Failure to comply with these regulations is a criminal offence and can result in fines of up to £30,000.

What Council Inspectors Look For

When a council inspector visits an HMO — whether as part of a routine inspection or in response to a complaint — they will assess the property against the Housing Health and Safety Rating System (HHSRS). Key areas of focus include the condition of kitchens and bathrooms, the presence of damp and mould, the adequacy of ventilation, the condition of communal areas, and the provision of adequate refuse disposal facilities. A property that is dirty, damp, or poorly maintained is likely to receive a Category 1 or Category 2 hazard notice, which can require immediate remedial action.

End of Tenancy and Void Period Cleaning

At the end of a tenancy, HMO landlords are responsible for ensuring the property is cleaned to a standard that is safe and habitable for the next occupant. This is particularly important in HMOs where individual rooms may have been occupied by tenants with varying standards of cleanliness, or where communal areas have accumulated significant dirt and grime.
